FDA’s New Claim: “Your Body Is a Drug—and We Have the Authority to Regulate It!” [ARTICLE]

In another outrageous power-grab, FDA says your own stem cells are drugs—and stem cell therapy is interstate commerce because it affects the bottom line of FDA-approved drugs in other states!

We wish this were a joke, but it’s the US Food and Drug Administration’s latest claim in its battle with a Colorado clinic over its Regenexx-SD™ procedure, a non-surgical treatment for people suffering from moderate to severe joint or bone pain using adult stem cells.

The FDA asserts in a court document that it has the right to regulate the Centeno-Schultz Clinic for two reasons:

Stem cells are drugs and therefore fall within their jurisdiction. (The clinic argues that stem cell therapy is the practice of medicine and is therefore not within the FDA’s jurisdiction!)
The clinic is engaging in interstate commerce and is therefore subject to FDA regulation because any part of the machine or procedure that originates outside Colorado becomes interstate commerce once it enters the state. Moreover, interstate commerce is substantially affected because individuals traveling to Colorado to have the Regenexx procedure would “depress the market for out-of-state drugs that are approved by FDA.”

We discussed the very ambiguous issue of interstate commerce last September—it’s an argument the FDA frequently uses when the basis for their claim is otherwise lacking. As we noted then, the FDA holds that an “interstate commerce” test must be applied to all steps in a product’s manufacture, packaging, and distribution. This means that if any ingredient or tool used in the procedure in question was purchased out of state, the FDA would in its view have jurisdiction, just as they would if the final product had traveled across state lines.

This time the FDA just nakedly says in court documents that the agency wants to protect the market for FDA-approved drugs. No more beating around the bush—their agenda is right out in the open! This appears to be a novel interpretation of the Food Drug and Cosmetic Act (FD&C), as evidenced by the government’s failure to cite any judicial precedent for their argument.

The implication of the FDA’s interpretation of the law, if upheld by the court, would mean that all food, drugs, devices, and biologic or cosmetic products would be subject to FDA jurisdiction. The FDA is expanding its reach even to commerce within the state, which we argue is far beyond its jurisdiction, in order to protect drug company profits.

Last year we ran a two-part series on the current status of federal and state law—and FDA jurisdiction—and how it affects integrative treatments (part one and part two).

The Centeno-Schultz Clinic takes your blood, puts it into a centrifuge machine that separates the stem cells, and a doctor puts them back in your body where there is damaged tissue. The clinic has argued numerous times that stem cells aren’t drugs because they are components of the patient’s blood from his or her own body.

The FDA says otherwise: “Stem cells, like other medical products that are intended to treat, cure, or prevent disease, generally require FDA approval before they can be marketed. At this time, there are no licensed stem cell treatments.” There they go again, saying that components of your body are drugs and they have the authority to regulate them! It’s the only way the agency can claim that adult stem cell therapy is within FDA’s purview.

However, the agency seems to be of two minds. When ESPN magazine was doing a story on stem cell treatments, the FDA stated that US policy is to allow the injection of stem cells that are treated with “minimal manipulation,” which federal regulations define as “processing that does not alter the relevant biological characteristics of cells or tissues”—which is certainly the case with the Regenexx clinic.

Despite this policy, FDA has been attacking the clinic for the past four years. They have tried injunctions and demanded inspections in their attempts to make the company bend; this court battle is merely the latest salvo.

The primary role of adult stem cells in a living organism is to maintain and repair the tissue in which they are found. The hard part has been to get enough of them. But new technology is giving doctors the ability to obtain more stem cells from a patient than previously thought possible, which is why we’re now seeing new treatments. Blood, fat, or tissue is withdrawn from the patient, stem cells are obtained using one of these new processes, and the cells are injected back into the patient where they can repair the patient’s tissue.

Gov. Rick Perry received this kind of stem cell therapy. We and others noted that the governor’s defense of freedom of healthcare choice when it came to his own treatment was starkly at odds with his directive to administer HPV vaccines to young girls against their own (and their parents’) wishes. It’s also at odds with his support for some of the most egregious witch-hunters on the Texas State Medical Board, which he appoints.

Behind Perry’s blatant inconsistency and the latest FDA attempted power grab lies the same problem: a medical system run by special interests under the leadership of the US government, the same government that is supposed to represent “we the people.”

Set first in Chicago, and later in Los Angeles, the Soul Train dance party reached national significance and became the longest running syndicated show in television history. "Soul Train" creator Don Cornelius was found dead at his Sherman Oaks on home Wednesday morning.

Law enforcement sources said police arrived at Cornelius' home around 4 a.m. He apparently died of a self-inflicted gunshot wound, according to sources, who spoke on the condition of anonymity because the case was ongoing.

The sources said there was no sign of foul play, but the Los Angeles Police Department was investigating.

In a 2010 interview with The Times, he said he was excited about a movie project he was developing about "Soul Train."

"We've been in discussions with several people about getting a movie off the ground. It wouldn't be the 'Soul Train' dance show, it would be more of a biographical look at the project," he said. "It's going to be about some of the things that really happened on the show."

According to a Times article, Cornelius’ “Soul Train” became the longest-running first-run nationally syndicated show in television history, bringing African American music and style to the world for 35 years.

Cornelius stopped hosting the show in 1993, and “Soul Train” ceased production in 2006.

[Updated at 7:31 a.m.: Cornelius was 75 and had recently been divorced. The sources say he was discovered by a family member early Wednesday morning, suffering from a gunshot wound to the head. He was rushed to a hospital, where doctors pronounced him dead.]

In fact, Hazel Jones did not feel embarrassed if there is a female friend who wanted to see double genitalia which he had, not only friends, every woman who wants to see will be shown by delight.

With this situation, Hazel does not ever feel worried or embarrassed, he was accustomed to ridicule from friends and people in the neighborhood. In fact, he refused to perform surgery because worry will leave a scar on her stomach.

Dr Dawn Harper who handles Hazel explained that the condition was caused by the formation of sexual organs imperfectly during in utero. When developing in the womb, female fetuses have two lines which when born will converge to form a single uterus. "Women who have two separate uterine really rare," he said.

Hazel Jones, 27, said it means she has lost her virginity twice. But she added she was so at ease with her body that she goes to sex clubs with her husband.

First, Hazel told ITV1?s This Morning hosts Holly Willoughby and Phillip Schofield she was 18 before being diagnosed with uterus didelphys.

It occurs when a barrier between two tubes that form the uterus fails to break down during development, leaving two internal channels.

Hazel, of High Wycombe, Bucks, did not realise she was different until her periods started at 14. She said: “I told friends. They looked even more confused than me.”

She went to hospital four years later to learn the truth. She added: “I thought it was amazing.”

Hazel told The Sun she and hubby Riki visited fetish clubs, explaining: “It shows how relaxed I am.

“My quirky condition does not make me shy or hold me back. In fact, it’s something I celebrate.”

Minority Report Is Real: FBI Wants To Use Social Networks To Prevent Future Crime [ARTICLE]

The Federal Bureau of Investigation is looking into the creation of an application that would allow it to better mine social media content, in an attempt to more accurately identify, target and fight “emerging threats” in real-time. The application could also be used to predict potential threats before they even happen.

According to a Request for Information (RFI) posted to the Federal Business Opportunities website, the FBI says it hopes to “determine the capability of industry to provide an Open Source and social media alert, mapping, and analysis application solution.” This tool would allow the FBI to “quickly vet, identify, and geo-locate breaking events, incidents and emerging threats” using “publicly available” information posted to social networks, like Facebook and Twitter, as well as local and national news publications.

Of course, monitoring social media is nothing new for the law enforcement community. At present, however, it’s simply too ineffectual and inefficient for the FBI’s needs.

“Social media is a valued source of information to the [FBI's Strategic Information and Operations Center (SIOC)] intelligence analyst in routinely monitoring events,” says the RFI. “Analysts have standing intelligence issues that they monitor as a matter of daily course around the globe. It is also seminal in their effort to provide initial information about single events of significance to law enforcement. Social media has become a primary source of intelligence because it has become the premier first response to key events and the primal alert to possible developing situations.”

The application the FBI hopes to have built would simply make this process easier and more thorough.

Here’s how the FBI envisions the app working: The information gathered from news and social media outlets would be overlaid onto a digital map, pinpointing the location of the “breaking events,” along with all other relevant contextual data. Additional information, including US domestic terror data, worldwide terror data, the location of all US embassies, consulates and military installations, weather conditions and forecasts, and traffic video feeds, would also be overlaid on the map.

A robust search feature would also be incorporated into the app, which would allow the ability to “instantly search and monitor key words and strings in ‘publicly available’ tweets across the Twitter Site and any other ‘publicly available social networking sites/forums,” according to the RFI. The FBI wants the search function to allow for simultaneous key word searches “that can look at 10 or 20 separate incidents/threats at the same time within the same ‘window.’” The ability to monitor tweets and other social media data in a minimum of 12 foreign languages, and to “immediately translate” those posts into English, is also outlined as a required feature of the application.

The future is now

All of that seems fairly straight forward. In fact, we are surprised the FBI doesn’t already have such an application at their disposal, since all of the features it outlines are well within the capabilities of a skilled software development team. Not to mention the fact that much of what the FBI hopes to use already exists in different parts. Websites like OpenStatusSearch.com, YourOpenBook.org, TweetScan.com and Tweepz.com make it possible to quickly and easily search for key words being posted publicly to Twitter and Facebook. All the FBI’s dreamed-up app would do is combine these features into a single product, and expand them with additional governmental and law enforcement data, and mapping tools.

However, the FBI doesn’t just want to know about what’s happening now; it also wants to predict events that are about to happen — to predict the future. If that sounds suspiciously like Minority Report, you’re not alone.

“Social media will be critical to meeting the intelligence objectives stated above because it provides unique access to communications about the special event [i.e. political conventions, national holidays, or sporting events] in advance of its occurrence,” reads the RFI.
As with the ability to search tweets and updates, using social media to predict the future is nothing new. In March 2011, the Journal of Computational Science showed that tweets could be used to predict upcoming fluctuations of the Dow Jones Industrial Average to an accuracy of 86.7 percent. And just this month, the Rand Corporation analyzed tweets from 2009 that used the hashtag #IranElection, and found that an increase in swear words it tweets could be used to predict where and when protests and other forms of public discontent would occur.
Using predictive technology isn’t limited to academics, governments, or corporations, either. The website RecordTheFuture.com allows anyone with an account to access troves of information about potential upcoming events, including product releases, stock fluctuations, and even upcoming vacation plans of private individuals.

Is everyone a target?

In other words, the worlds of Aldous Huxley and George Orwell have already arrived. The FBI simply wants to create a custom application that combines already-available technology, and streamlines it, in an attempt to do their job better. That’s all good and well when if it’s used to stop truly “bad guys,” like terrorists who want to blow up a football stadium. The problem is, who do they consider “bad guys” nowadays? Hackers like Anonymous? Wikileaks supporters? Occupy Wall Street protesters? Everyone?

The most cautious (and possibly wisest) among us would say all of the above. And it’s increasingly hard to refute their warnings. Late last year, President Obama signed the latest iteration of the National Defense Authorization Act (NDAA), a law that comes up for annual renewal. The problem with this year’s version, say critics, is that it includes provisions that would allow the US military to detain anyone — including US citizens — anywhere in the world, without trial or due process, if they are suspected of terrorist activities. Moreover, NDAA provides such an ambiguous definition of “terrorist activity” that groups like Occupy Wall Street or Anonymous could fall under this perilous category.

It must be pointed out that, President Obama included a signing statement with NDAA that guaranteed that his administration would not use the law to indefinitely detain US citizens. But that has done little to quell the cognizant public’s outrage.

So, what to make of all this? Most obviously, it is now painfully clear that everything we post online is being watched. And if the FBI gets its new application — which seems to us an inevitability — the eyes with which it sees our tweets and updates will have bionic vision, and even the ability to peer into the future. What is less obvious is how the government’s quest to protect the public good will be abused to trample legitimate free speech and lawful public dissent.
In short: Big Brother is real. He is watching. So be careful what you say online today — it could be used against you tomorrow.

Japanese artist Isao Hashimoto has created a beautiful, undeniably scary time-lapse map of the 2053 nuclear explosions which have taken place between 1945 and 1998, beginning with the Manhattan Project's "Trinity" test near Los Alamos and concluding with Pakistan's nuclear tests in May of 1998. This leaves out North Korea's two alleged nuclear tests in this past decade (the legitimacy of both of which is not 100% clear).

Each nation gets a blip and a flashing dot on the map whenever they detonate a nuclear weapon, with a running tally kept on the top and bottom bars of the screen. Hashimoto, who began the project in 2003, says that he created it with the goal of showing"the fear and folly of nuclear weapons." It starts really slow — if you want to see real action, skip ahead to 1962 or so — but the buildup becomes overwhelming.

The FEDS Kill Megaupload [ARTICLE] End Piracy, Not Liberty!

The Department of Justice announced Thursday that it has conducted a major action to shut down MegaUpload, a popular file-sharing site widely used for free downloads of movies and television shows.

After receiving indictments from a grand jury in Virginia for racketeering conspiracy, conspiracy to commit copyright infringement and other charges on Jan. 5, federal authorities on Thursday arrested four people and executed more than 20 search warrants in the U.S. and eight foreign countries, seizing 18 domain names and an estimated $50 million in assets, including servers run in Virginia and Washington, D.C.

MegaUpload is a "digital locker" that allows users to store files that can then be streamed or downloaded by others. Its subsidiary site MegaVideo became very popular for the unauthorized downloads of movies and TV shows. Users whose uploaded content proved particularly popular were paid for their participation.

In a joint statement, the Justice Department and FBI called the action "among the largest criminal copyright cases ever brought by the United States."

Ira Rothken, an attorney for MegaUpload, said in an interview that he only learned of the actions in a press release this morning and had not yet read the entire indictment. "Our initial impression is that the allegations are without merit and MegaUpload is going to vigorously contest them," he said. "We have deep concerns over due process and assets being taken without the opportunity for a hearing."

According to the indictment, the operators of MegaUpload earned more than $175 million in illegal profits and caused an estimated $500 million in harm to copyright holders.

The site is advertised as having more than 50 million daily visitors, according to federal authorities.

Four of MegaUpload's operators have been arrested in New Zealand, while three more remain at large. The seven each face a maximum of 55 years in prison.

Not listed on the indictment is rapper Swizz Beatz -- real name Kasseem Dean -- who, according to a report in the New York Post, is the CEO of MegaUpload. Beatz is married to pop singer Alicia Keys.

Rothken said that Beatz had not been running the site but that recently there had been "a transition period going on."

The news is sure to be welcome in the entertainment industry, whose leaders have faced a recent setback in their push for the Stop Online Piracy Act and Protect Intellectual Property Act. The proposed bills, if passed, would make it easier for U.S. courts to go after piracy sites that, unlike MegaUpload, operate entirely overseas.

Critics who believe the bills are heavy-handed and don't adequately protect civil liberties conducted a U.S. Internet "blackout." As many as 10,000 websites went black Wednesday, among them Wikipedia, Craigslist and Reddit. The protest helped to pressure lawmakers to oppose SOPA and PIPA.

The Obama administration announced its opposition to the bills in their current forms Saturday.

DEFRA says chemicals added to aviation fuel can be a cost effective way to spray a so-called protective screen as to block out the suns rays and reduce global warming. ( This however would have an opposite effect. Please look up Global Dimming and the Hydrological Cycle on Google. ) BUT, is this really about protecting the earth or is it about stopping you receiving natural sunlight and making vitamin D?

Vitamin D is important for helping the immune system fight the flu virus. One reason why the flu may be more contagious in the winter time is because of the lack of sunlight. The lack of sunlight prevents our skin from producing sufficient levels of vitamin D. There is now documented evidence about the roles of solar ultraviolet-B radiation and vitamin D in reducing case-fatality rates from the 1918-1918 influenza Pandemic in EU.

I quote: There are two mechanisms whereby vitamin D can reduce the risk of death once the pandemic influenza virus infection took hold: reduced production of pro-inflammatory cytokines and reduced risk of bacterial pneumonia.

The type of vitamin D which can fight viruses can ONLY be made from natural sunlight. It is known as D3, which is made from sunlight when 7-dehydrocholesterol in our skin reacts with UV light.

I quote: It is then twice activated in the liver and kidney to make 1,25-dihydroxyvitamin D. This attaches to receptors on genes that control their expression, which turn protein production on or off. Vitamin D regulates the expression of more than 1,000 genes throughout the body. They include genes in macrophages, cells in the immune system that, among other things, ATTACK AND DESTROY VIRUSES.

Which mean the vaccination doesnt work so well as a unsuppressed immune response is needed to build up anti-bodies and immunity to that particular vaccine. So another reason to block out the natural sunlight.

If our governments were so concerned about the swine flu surely they would put a stop to these climate change experiments which blocks out everyones natural sunlight. The fact that they or the media will not even report on the chemtrails happening above us only leads me to be more suspicious of what the chemical spraying is really about.

The film, made by British television producer Martin Durkin, presents scientists, economists, politicians, writers, and others who dispute the scientific consensus regarding anthropogenic global warming.

The film's basic premise is that the current scientific opinion on the anthropogenic causes of global warming has numerous scientific flaws, and that vested monetary interests in the scientific establishment and the media discourage the public and the scientific community from acknowledging or even debating this. The film asserts that the publicised scientific consensus is the product of a "global warming activist industry" driven by a desire for research funding. Other culprits, according to the film, are Western environmentalists promoting expensive solar and wind power over cheap fossil fuels in Africa, resulting in African countries being held back from industrialising.

The film won best documentary at the 2007 Io Isabella International Film Week.

A number of academics, environmentalists, think-tank consultants and writers are interviewed in the film in support of its various assertions. They include the Canadian environmentalist Patrick Moore, former member of Greenpeace but for the past 21 years a critic of the organisation; Richard Lindzen, professor of meteorology at the Massachusetts Institute of Technology; Patrick Michaels, Research Professor of Environmental Sciences at the University of Virginia; Nigel Calder, editor of New Scientist from 1962 to 1966; John Christy, professor and director of the Earth System Science Center at University of Alabama; Paul Reiter of the Pasteur Institute; former British Chancellor of the Exchequer Nigel Lawson; and Piers Corbyn, a British weather forecaster.

Carl Wunsch, professor of oceanography at the Massachusetts Institute of Technology, was also interviewed but has since said that he strongly disagrees with the film's conclusions and the way his interview material was used.

Message from Talib Kweli about the song: "A little less a year ago, I got a beat from one of my favorite producers, Oh No, that I felt would be a perfect sound bed for the album I was working on, Prisoner Of Conscious. As I played the beat over and over trying to write lyrics, I kept finding myself distracted. By the TV, by twitter, by trivial things. I realized then that the beat was asking me to write about Distractions. Beats talk to me. They tell me what to rap about, they suggest a guest for the song. One of the things I was distracted by was the news coming from Tahrir Square last year. The Arab Spring was unlike anything I've seen in my lifetime. Beginning with a vegetable cart owner named Mohammed Bouazizi setting himself on fire in Tunisia to protest general unfair treatment, the Arab Spring spread like wildfire to Sudan and then to Egypt, as thousands of protestors occupied Tahrir Square to call for corrupt president Hosni Mubarak to step down. The first line that I wrote for my song Distractions was, "they say it ain't about the spoils of war, but turn around and tell you how much more the oil will cost." This was inspired by the Arab Spring. Fast forward to September, 2011. Occupy Wall Street exploded into the collective consciousness of the world, but it started right here in New York City. I didn't understand that this protest was something that was ongoing at first, so I did not pay much attention in the beginning. However, when I saw my contemporaries like Lupe Fiasco bringing blankets and Immortal Technique making multiple trips, I knew this was something I had a responsibility to be involved in. I went to Zucotti Park the day after I arrived back in NY. I traveled with Jamie Kilstein and Allison Kilkenny from Citizen Radio, and res, my partner in Idle Warship. What I saw made me proud of my hometown. Sure, I probably saw some homeless people. If the homeless aren't in the 99 percent, who is? What was more prevalent was the organization, the sense of community. I saw students, musicians, wall street types, blue collar types, older activists and fresh faced newbies. It was the most democratic, American thing I had ever witnessed. And to think, it was inspired by the Arab Spring, just like my song! I was asked to address the crowd at the General Assembly, which is a daily gathering to discuss the issues at hand and how the people can move forward. Even though I am accustomed to being an entertainer, the thought of addressing people who were literally giving everything they had to this cause was a bit overwhelming. It was in that moment that I made the connection between my song Distractions and OWS. I sort of sputtered out Distractions, because this was the first time I was ever saying it out loud. The response to it has been nice, largely because a clip of it has made the rounds online. However, it wasn't me kicking a verse that resonated the most with the people actually at Zucotti Park, it is what I said from my heart. When I stopped rapping and addressed the people directly, I had, in my opinion, a bigger impact. It showed me the humanity of the movement. We were one, stripped of our titles. I strive to be a great artist. But I also strive to be a greater man. I am not here to convince you one way or the other about Occupy Wall Street. I know how I feel about the movement and that's good enough for me. I was so inspired by what those people are doing for our future that I wanted to celebrate them in the video for Distractions. I had some reservations about it. I did not want to appear like I was capitalizing. I hope that people see this video as I intended it, as a love letter to the Occupy Movement everywhere. If you haven't heard by now, the world of music, and the Bay Area hip-hop scene, in particular, lost a Special One this weekend. Karryl Smith, half of the East Oakland-bred group the Conscious Daughters, better known as Special One, passed away on December 10. Her cause of death is unknown at this time.

As the Conscious Daughters, Smith and Carla Green (aka CMG) were a breakthrough act in the early Nineties, a pair of street-smart and fly ladies who rapped as relentlessly tough as any of their male counterparts. Buoyed by the singles “Somethin’ To Ride To (Fonky Expedition)” and “We Roll Deep,” the debut album Ear to the Street dropped in 1993 on Priority Records via Scarface Records, an imprint helmed by the politically charged rapper Paris. The album hit the Billboard Top 200 and R&B/Hip-Hop Top 25, and Gamers followed in 1996, with its title track affirming that women had considerable macking and sporting skills of their own.

Paris also released the group’s third and final album The Nutcracker Suite on his Guerilla Funk label in 2009, praised for its balance of street hard tracks and female empowerment anthems. More recently, Smith and Green had departed the label and signed an agreement for their own company Llerrad Music to be distributed through Sony Red. CMG released a solo album, Jane of All Trades, in June, and the duo was getting ready to drop the fourth album from the Conscious Daughters.

The stereotypical image of the female rapper in 2011 is hyper-sexualized and animated, but back in the Nineties, women such as the Conscious Daughters were allowed to be rugged, strong, and smooth, and still be recognized for their lyrical talents and abilities.

Carla Green posted a message regarding Smith's death on her Facebook page, writing, "Thank you to everyone for your prayers I need them. I am sick over the loss of my sister. The cause of death is still unknown but I will try to share info when I get it. Pray for me and Karryl's other sisters Jessica and Tonya. We are all together trying to get through this."

“We know inside that we’re the best at what we do,” Special One told Bay Area writer and activist Davey D in a 2009 interview,“We love what we do and we can flow with the best of them.”

Paris adds, "Karryl was one of the sweetest, kindest people I've ever had the pleasure of crossing paths with. She was genuine, talented and brutally honest. She will be missed."

We have set up a memorial fund so the family can give her a beautiful home going. She meant so much to so many people.
